The User does not acquire any right over this Content, except for the limited, non-exclusive, and non-transferable license to use the Services as permitted by these Terms.
6. User Content
When the User submits or makes Content available through the Services (e.g., comments, uploads, created materials), they grant ARC Studio a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, and display that Content as necessary to provide the Services. The User declares that they are the owner or have legal authorization to use and grant this license. ARC Studio may remove or refuse any Content that violates these Terms or applicable laws.
7. Payments and Billing (If applicable)
If any Service is paid, prices, fees, and payment methods will be defined separately. The User agrees to pay all associated fees and accepts that ARC Studio may add, modify, or remove plans upon prior notification. There are no refunds, unless expressly provided otherwise.
8. Disclaimer of Warranties
The Services are provided “as is” and “as available.” ARC Studio does not warrant that the Services will be uninterrupted, error-free, secure, or suitable for a specific purpose. The User uses the Services at their own risk.
9. Limitation of Liability
In no event shall ARC Studio be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of data, profits, or revenue, arising from the use or inability to use the Services — even if advised of the possibility of such damages. ARC Studio's total liability shall be limited to the amount actually paid by the User for the Services, if any.
10. Suspension and Termination
ARC Studio reserves the right to suspend or terminate any User’s access to the Services, at any time and for any reason — especially in case of a violation of these Terms. The articles that, by their nature, must survive termination (such as Intellectual Property, Limitation of Liability, etc.) will remain in effect after termination.
11. Modifications to the Terms
ARC Studio may modify these Terms at any time. By continuing to use the Services after the modifications, the User agrees to the revised Terms. If the User does not agree, they must stop using the Services.
12. Privacy and Data
The use and processing of personal data are governed by ARC Studio's privacy policy. By using the Services, the User agrees to the collection, use, and storage of their data as described in that policy. (If one doesn't exist — it is recommended to create a separate policy.)
13. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of Brazil. Any disputes will be settled in the competent court in the district where ARC Studio is headquartered — unless otherwise provided.
14. General Provisions
The failure to exercise any right or clause of these Terms does not constitute a waiver of that right. If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between the User and ARC Studio regarding the Services.
